Legal: Some Good News for the 10 Year Home Warranty Law
The "statute of repose" BAM passed in 2004 was upheld at the MN Court of Appeals this past week.
Remember the nightmare of a court case that exposed a loophole in the law that allowed a builder to be sued outside the 10-year warranty period?
Oh yeah, I bet you tried to forget that one. It took BAM over three years to pass the bill at the legislature but we did it and we put a finite time frame on how long a builder is liable for warranty obligations.
The Courts upheld the changes we made to the law in a recent decision.
